Terms of service

The rights of the character belong to the commissioner.
The rights of the art belong to me the artist.
I have the right to decline the commission.

You may

  • Use the commission for personal purposes.

  • Distribute/Share for Non-Profit purposes.

You may NOT

  • Use it for profit or any commercial purposes (Unless agreed upon that this is a commission for Commercial use)

  • Claim the art as your own.

  • Distribute/Share the work without proper Credit to me the artist.

  • Use as an NFT (Non-Fungible Token) or any variants of Cryptocurrencies.

  • Use to train/be a base or be involved in any sort of “AI” art application and the like.

Credit

  • Full credit must be given on reupload/distribution/etc…

  • Full Credit is to either tag me @skyhighnoms in the post and/or link my appropriate social media account (My carrd is not necessary)

Switching/Deactivating accounts

  • If you deactivated or switched accounts, please provide me with a new account to contact. Ghosting or failure to do so within 1 Month will be considered as a dropped commission.

  • After the given grace period, said pending commission will be retracted; as well as put you in a Probation list. Multiple instances of this will move you to my Blacklist.

  • I may finish the commission and post it on my social media.

Commission Process

By Commissioning me you have read and agreed to my Terms and Conditions.
You have also confirmed you are of Legal age or have permission/consent from a Legal Parent or Guardian to pay for my services.Price & Payment:
- Prices listed down are the BASE price and will be affected by various factors that may or may not increase the final fee. Main mode of payment will be through PayPal and/or GCash.- NO REFUNDS! The only instance I'll offer a refund is if there is a severe and/or sudden unexpected event on my side that will outright not let me finish the commission.Factors that will affect final price includes but is not limited to:

  • Complex details

  • Number of Individual Characters

  • Poses/Perspectives

  • Background complexity and details

  • Adding a Deadline

  • Commercial/Promotional/Advertisement use

Payment without any prior discussion, notice, shall be received as a Donation. Do not send anything in advance until properly discussed.

Process

There will be NO initial Deadline. Adding a deadline will add additional fees depending on when it is needed. Commission time ranges from 1 week to 1 month, I will be informing you of anything that may delay the commission with or without a deadline.

50% Base price shall be paid upfront.

During this initial stage after payment, I will be sending you the commissioner screenshots of the sketch/lineart/base-coloring.
The commissioner may request as many changes to the sketch and base coloring as they wish, it is advised to state any concerns during this early stage (but please do not abuse this, I can and will drop the commission at anytime I wish)After finalising the Lineart the remaining 50% must now be paid.
During this second stage I will be sending screenshots and other images of the color/rendering. The Commissioner will be allowed only “2” free major changes to the finalised Lineart, any additional change shall be an additional $5-$10 depending on the complexity.(Minor changes for rendering or due to my own technical mishaps won’t be counted)When the artwork has been finalised, I will be sending the Transparent files as well as the CSP/PSD files through email or Drive link. After confirmation that all files are in working order the commission is now officially completed.

NDA (non-disclosure agreement)

If you the commissioner wishes the art to be kept in private, you may pay a fee of 10% of the final price and I will refrain from posting the commission indefinitely or until you the commissioner grants me permission to do so.

Filing of Chargebacks, being excessively Rude, and the like, will grant you a spot in my blacklist. You shall be permanently banned from commissioning me; All art and pending commissions from you shall be retracted.

FAQs

Art you are comfortable drawing?
Yes:

  • Mecha

  • Very detailed objects (props, weapons, clothes, etc…)

  • Backgrounds

No

  • Furries or any of the variants (Scalies, Featheries, etc…Characters with some animal characteristics are OK.) excessively buff people (Emphasis on “Excessive”), and NSFW (I’m fine with blood and gore to some degree, suggestive is OK, fully explicit is a No).

  • It is not because I don’t want to draw or dislike them, it’s because I’m not experienced enough to draw them so I may not reach the standard of quality I want to give my clients

  • Chibis are the bane of my existence please never comm me for chibis I will cry.

  • Logos, calligraphy

  • Realistic images.

  • Political themes.

For Adopts

Files will be sent once payment is confirmed.

  • For those with payment plans, only after it has been fully paid will the files be sent over.

  • Please provide a preferred email address for the files to be sent over once payment confirmation is done.

You may not edit the original design without prior approval and/or discussion regarding it.

  • You may edit around 15-20% of the purchased design.

  • If it's a minor change (eg: Adding small accessories) you may do so without needing any approval.

  • Changing the outfits are allowed so long as it fits the overall design theme and color palette.

  • I have the right to decline on changes that goes against the initial theme/concept of the Adopt.

  • DO NOT PURCHASE a design if you are unhappy/dislike the theme.

If you are unsure of any changes you would like to do, please do not hesitate to contact me so we may discuss it properly.

  • If any of these stated rules are broken, most especially if I am made aware you bought a design and immediately resell it because you did not like it, will be put on my BLACKLIST as it is already stated that all of these can be discussed properly and avoided.
